An advanced personal plan generally takes effect when the donor is unable to make his or her own decisions due to age, illness, or accident. In this case, the lawyer can make lifestyle, legal, and financial decisions on their behalf. Here the lawyer can decide which treatment the donor needs to undergo and where to invest his money. The donor can appoint an attorney to make decisions on their behalf immediately or at any time after they are unable to make their own decisions.
What does a General Power of Attorney (NT) include and what does not?
The document is a legal and formal form that contains a description of the attorney’s powers.
Included
The document contains:
- A statement confirming the appointment of the lawyer who is at least 18 years old.
- A description of the authority, indicating the authority and scope of authority conferred on the attorney.
- Date of beginning of powers and period of validity of the document. If the document does not have a fixed end date, it will become invalid if the client loses his ability to make decisions or dies.
- Signatures of the witness, the client and all lawyers. The witnesses include the justice of the peace, the oath commissioner, a police officer or a lawyer.
Not included
- The document does not give the attorney any powers other than financial controls.
Once signed by all parties, the form becomes a legal document that is valid in the event of a dispute in court.
Do I need an attorney for a general power of attorney?
