New York recently passed Senate Bill (SB) 888, which, among other things, adds the requirement that two uninterested witnesses sign a power of attorney and make technical changes to the legal short form of the power of attorney. The provisions of SB 888 come into force on June 13, 2021.
SB 888 requires that a power of attorney carried out by a client must be witnessed by two persons who are not named in the instrument as representatives or authorized recipients of gifts. In addition, SB 888 extended the exemption for third parties to comply or refuse legal authority within ten business days to involve the Department of Health, including social services counties, in the administration of the Medicaid program or other public health insurance programs.
