How to request a power of attorney refund

You are entitled to a fee paid between April 1, 2013 and March 31, 2017 for registering a permanent power of attorney in England or Wales. You can claim whether you were the donor (the person who issued the power of attorney) or the lawyer (the person appointed by the donor) even though the refund is paid to the donor. You can assert claims even if the power of attorney has been used.

You can request a refund online. However, if you have problems you can call the guardian’s office on 0300 456 0300 (select option 6). To apply, you don’t need the power of attorney itself, but you will need:

  • Name, address and date of birth of the donor.
  • Your UK bank account number and routing number.
  • The name of one of the attorneys on the power of attorney.

Here are the other worth knowing:

  • You only need to make one claim for each donor – even if you have submitted multiple powers of attorney.
  • It can take up to 12 weeks for your claim to be processed and paid.
  • If your claim is denied and you want to appeal, call the hotline on 0300 456 0300 and choose option six.
  • If the donor does not have a UK bank account or you are a court appointed representative, you will need to apply over the phone.
  • You can also apply for a permanent power of attorney if you have registered it in the relevant period. The permanent power of attorney was replaced by the permanent power of attorney on October 1, 2007. However, if someone could have subscribed to this before the cut-off date and registered during the refund period, it would be eligible.

If the donor has died, you can still make a claim, but you must contact us by email (contact [email protected]) or post (POA Refunds Team, 7th floor, Guardian’s Office, PO Box 16185 ) apply, Birmingham, B2 2WH) instead. You will need to send a copy of the donor’s death certificate and will or a representation such as an inheritance grant or administrative letter along with your contact details.

The application deadline is January 31, 2021. According to the Ministry of Justice, subsequent applications can still be checked – but it is worth submitting your application in advance to be sure.
