In cooperation with both Ganbei! and China Business Law Podcasts, member Timothy O’Toole discussed Xiaomi’s successful legal action against the DoD’s list of Chinese Communist Military Enterprises (CCMC). Xiaomi has filed the lawsuit in a US district court to challenge the fairness of the US ban process because Xiaomi is not owned or controlled by the Chinese military. The court ruled in Xiaomi’s favor because the DoD memo failed to show that Xiaomi and the Chinese military were linked as properly defined. “The idea that a company could go to US courts and challenge a national security order and win quickly … was really unknown,” said O’Toole.
